CERCLA and EPCRA Reporting Requirements for Air Releases of Hazardous Substances from Animal Waste at Farms

On February 1, 2018, the U.S. Court of Appeals for the DC Circuit announced a stay of the mandate for CERCLA/EPCRA reporting for livestock and poultry producers until May 1, 2018. Producers with reportable quantities of emissions will not be subject to reporting obligations until at least May 1, 2018. KFB will continue to monitor this situation and provide information to our members when there are additional updates.
